  • Interfere with the normal operation of the Services, including by uploading malware or automated bots.

5. Intellectual Property Rights

All content, design, text, data compilations, and materials available through the Services are owned by or licensed to Local Health Inspections and are protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

6. User-Generated Content and License

If the Services allow user-generated content, you grant us a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use, reproduce, and display such content in connection with our Services.

You represent that your content does not infringe on any third-party rights and is not defamatory, unlawful, or misleading. We reserve the right to remove any content that violates these Terms or applicable law.

7. Payment Terms

Our Services are currently offered free of charge. We may display third-party advertisements to support our operations. We do not sell products, accept payments, or offer subscriptions directly through our Services at this time.

8. Disclaimer of Warranties and Limitation of Liability

Our Services are provided “as is” and “as available” without warranties of any kind, express or implied. We make no representation or warranty that the information provided is complete, accurate, or up to date, or that the Services will be uninterrupted, secure, or error-free.

The inspection data displayed originates from public sources managed by local health agencies across Canada. Local Health Inspections does not guarantee the accuracy, timeliness, or completeness of this data and is not responsible for any errors or omissions.

To the fullest extent permitted by law, we disclaim all liability for damages, including but not limited to direct, indirect, incidental, or consequential losses; damages resulting from use or inability to use the Services; and errors in third-party data or external links.

9. Termination of Service

We reserve the right to suspend or terminate access to the Services at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, all licenses and rights granted to you will immediately cease.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of Ontario, Canada, without regard to conflict-of-law principles.

Binding Arbitration

Any dispute or claim arising out of or relating to these Terms or the Services will be resolved through binding arbitration before a neutral arbitrator located in Ontario, Canada. The arbitration will be conducted in English and in accordance with applicable arbitration procedures under Canadian law.

You agree that arbitration is the exclusive means of resolving disputes between you and us, and you waive your right to participate in class actions, class arbitrations, or consolidated proceedings.
